Terms of Service

These Terms of Service govern your use of sporestrike.co and any purchase you make from Sporestrike Labs, a brand of Kaptagon Corporation (“we”, “us”). By using the site or placing an order, you agree to these terms.

1. Eligibility

You must be at least the age of majority in your state, province, or country to use this site or place an order. You may not use our products for any illegal or unauthorised purpose.

2. The products

Sporestrike Fungal Care Serum is a cosmetic personal care product. It is not a drug and is not intended to diagnose, treat, cure, or prevent any disease. These statements have not been evaluated by the U.S. Food and Drug Administration.

If you have a diagnosed medical condition — including diabetes, circulatory conditions, or a compromised immune system — or if you are pregnant or nursing, consult a healthcare professional before use. Discontinue use and seek advice if irritation occurs.

3. Product information and accuracy

We make reasonable efforts to describe our products accurately. Colours and images may display differently on different screens. We do not warrant that product descriptions, pricing, or other content is error-free, and we reserve the right to correct errors and to update information at any time without notice.

4. Orders and pricing

All prices are in US dollars and are subject to change without notice. We reserve the right to refuse or cancel any order, including where we suspect fraud or where an item was listed at an incorrect price. If we cancel an order after payment, we will refund it in full.

Applicable sales tax is calculated and added at checkout.

5. Payment

Payments are processed by Stripe. By submitting payment information you represent that you are authorised to use the payment method and that the information you provide is accurate. Your use of Stripe’s checkout is additionally governed by Stripe’s terms.

6. Shipping and returns

Shipping timeframes, destinations, and costs are set out in our Shipping Policy. Returns and refunds are governed by our Refund Policy. Both are incorporated into these terms.

Risk of loss passes to you upon delivery to the carrier.

7. Intellectual property

All content on this site — text, images, logos, product photography, formulations, and the Sporestrike name and marks — is owned by Kaptagon Corporation or its licensors and is protected by intellectual property law. You may not reproduce, distribute, or create derivative works from it without written permission.

8. Acceptable use

You agree not to: use the site for any unlawful purpose; attempt to gain unauthorised access to the site or its systems; transmit malware; scrape or harvest data by automated means; or interfere with the operation of the site.

9. Third-party services

The site relies on third-party services including Cloudflare (hosting and DNS), Stripe (payments), Klaviyo (email), and analytics providers. We are not responsible for the content, policies, or practices of third parties. Links to third-party sites are provided for convenience only.

10. Disclaimer of warranties

The site and products are provided “as is” and “as available” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

We do not warrant that use of the product will produce any particular result. Individual results vary.

11. Limitation of liability

To the fullest extent permitted by law, Kaptagon Corporation and its officers, employees, and agents shall not be liable for any indirect, incidental, punitive, or consequential damages arising from your use of the site or products. Our total liability for any claim shall not exceed the amount you paid for the product giving rise to the claim.

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless Kaptagon Corporation from any claim or demand, including reasonable legal fees, arising out of your breach of these terms or your violation of any law or the rights of a third party.

These terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions.

14. Severability

If any provision of these terms is found unlawful or unenforceable, that provision shall be severed and the remaining provisions shall remain in full force.

We may update these terms at any time. The current version is always posted on this page with its last-updated date. Continued use of the site after changes constitutes acceptance.
